Welcome, and thank you for your interest in Leave your luggage in Sofia!

These Terms of Agreement (“Terms”) are a binding legal agreement between you and “Leave your luggage in Sofia’’ regarding your use of the websites, applications, networks, and other services provided by Leaveyourluggageinsofia.com (collectively, the “Leave your luggage in Sofia Platform”). In these Terms of Agreement, “Leave your luggage in Sofia”, “we,” “us,” or “our” refer to Sofia Wine Walk LTD.

Key principles in Terms of Agreement

  • We created an online platform for Customers who wish to store their personal items for a short period of time to connect with Partners who have available short-term storage space to offer. Customers can use the Leave your luggage in Sofia platform.
  • To access and use the Leave your luggage in Sofia Platform you simply enter our website (leaveyourluggageinsofia.com) and add your payment details. You must make sure that the information you provide to us is accurate and up-to-date at all times.
  • Please read these Terms of Agreement carefully before accessing and using the Leave your luggage in Sofia Platform. They include important information about us, your rights, and obligations. 
  • We may change these Terms from time to time. If we make any changes, we will let you know about those changes by publishing the up-to-date version of these Terms of Agreement on our website.

ABOUT US

We are Sofia Wine Walk LTD., a Bulgarian company registered at Kashin, 7 Vasil Drumev Str., in Sofia, Bulgaria. You can contact us at support@leaveyourluggageinsofia.com.

1. OUR ROLE IN TERMS OF AGREEMENT

1.1. Leave your luggage in Sofia has created an online platform (the “Leave your luggage in Sofia Platform”) to eligible users (“Customers”) who wish to store their personal items on a short-term basis to find and book available storage spaces and services from partners who have short-term storage space available at their locations and other services to offer (“Partners”). Customers may also connect with Partners to have their package(s) delivered and accepted at some Partners’ locations using the Leave your luggage in Sofia Platform. In these Terms, item(s), personal item(s), bag(s), luggage(s), and package(s) are often referred to as “Item(s).”

1.2. Leave your luggage in Sofia is the provider of the Leave your luggage in Sofia Platform, which allows Customers to connect with Partners at the physical locations they operate and control (“Partnering Location(s)”) in relation to the following services facilitated by us (collectively, the “Services”):

1.2.1. Storage Service. Customers may find and book available short-term storage space for their Items (“Storage Service”). 

1.2.2. Other Services. Leave your luggage in Sofia allows Customers to use the Leave your luggage in Sofia Platform to connect with Partners in relation to other services (“Other Services”). We will use our best efforts to notify you about those Other Services and the conditions attached to them via the Leave your luggage in Sofia Platform. We will notify you about any material changes we would make to these Terms to reflect which Other Services you can access and use via the Leave your luggage in Sofia Platform. 

At the current moment those Other Services include purchase of selected bottles of red and/or white Bulgarian wine, which are categorized in three separate categories: Standard, Premium and Super Premium. The purchase of the selected number of bottles of Bulgarian wine will be made available upon the payment of the Storage service.

The Other Services will be paid for by the Customers through the Leave your luggage in Sofia Platform entirely. The Leave your luggage in Sofia Platform is not accountable for bottles of wine which have been purchased by the Customer through the said Platform but have not been provided to the Customer at the Partner’s location. In such cases the sole responsibility will be held by the Partner who has not provided the Customer with the purchased bottles of wine.

1.3. These Terms of Agreement will only apply to the Services, and only to the extent they are concluded via the Leave your luggage in Sofia Platform exclusively and all interactions between you and the Partner occur via the Leave your luggage in Sofia Platform. 

1.4. Any products and services provided to you by a Partner outside the Leave your luggage in Sofia Platform are not subject to these Terms of Agreement. Those products and services are priced locally by Partners and subject to separate terms with those Partners. Apart from the Other Services, you must pay Partners directly for such products and services at the time of purchase or provision of those products or services at the location of the Partner.

1.5. Leave your luggage in Sofia does not own, control, or manage Partnering Locations. Leave your luggage in Sofia is not a party to any contracts that could be entered into between Customers and Partners nor is Leave your luggage in Sofia a payment provider, a broker, or an insurer.

2. LEAVE YOUR LUGGAGE IN SOFIA PLATFORM.

2.1. To be able to use the Leave your luggage in Sofia Platform you must be at least eighteen (18) years old. You can access the Leave your luggage in Sofia Platform and book our Services by adding your personal information (name, email, phone number) and payment details.

2.2. By agreeing to these Terms, you represent and warrant that: (a) you are at least eighteen (18) years old; (b) you are legally capable of entering into binding contracts; (c) you are a natural person acting on your own behalf or you represent a legal person and you have all the necessary power to represent and bind this legal person;

(d) you have not previously been suspended or removed from or prohibited from using the Leave your luggage in Sofia Platform under the laws of your place of residence, or any other applicable jurisdiction and (e) your registration and your use of the Leave your luggage in Sofia Platform and the Services will be in compliance at all times with all applicable laws and regulations.

2.3. When you request a Service provided by us, you will be required to provide Leave your luggage in Sofia with some information about yourself, such as your name, email address, phone number and payment details. Leave your luggage in Sofia will not use your personal information for other purposes apart from the use for sending you emails regarding your review and rate of the Service you have been provided with.

2.4. You must provide us with accurate, current, and complete information. You are solely responsible for maintaining the confidentiality and security of your credentials and may not disclose your credentials to any third party. You are responsible and liable for activities conducted with your credentials via the Leave your luggage in Sofia Platform unless such activities are not authorized by you and you are not otherwise negligent (such as failing to report the unauthorized use or loss of your credentials).

If you believe that your credentials have been lost, or stolen, or your account is otherwise compromised or no longer secured, please immediately notify us at support@leaveyourluggage.com.

3. PROHIBITED ITEMS IN TERMS OF AGREEMENT

3.1. You may not use the Leaveyourluggageinsofia Platform to store, deliver, receive, transport, or otherwise interact with, the following Items (collectively, “Prohibited Items”): 

3.1.1. Any Items whose possession or transportation is illegal under any applicable laws, including the laws of the location(s) where such Items are to be stored, delivered, received, or transported. 

3.1.2. Weapons, firearms, ammunition, explosive Items or substances, flammable liquids or gasses, pesticides or other toxic chemicals, live animals, agricultural products, perishables, alcoholic beverages, drugs, or other controlled substances that are not prescribed to you or purchased over-the-counter for your own personal use, cash or cash equivalents, lottery tickets, stocks, bonds, money orders, subjective or sentimental items, jewellery, precious stones and metals, jewels, gift cards, irreplaceable items (e.g., antiques, paintings), medicines, immigration documents, and other valuables.

3.1.3. Other Items that Partners or Leave your luggage in Sofia specify as prohibited. 

3.2. Leave your luggage in Sofia and their Partners have the right to inspect, in your presence, all Items deposited in connection with the Services and to reject any Prohibited Items or other Items that, in Leave your luggage in Sofia’s or the Partners’ reasonable discretion, present a danger to the Partner, the Partners’ personnel, other Customers, or the public.

Leave your luggage in Sofia and Partners may convey to law enforcement authorities any Item the possession, storage, delivery, or transportation of which may violate applicable laws. If a Partner rejects your Item, you should immediately contact Leave your luggage in Sofia at support@leaveyourluggageinsofia.com.

3.3.  Leave your luggage in Sofia and their Partners have no obligation to protect Prohibited Items against any loss, theft, or damage.

4. PAYMENTS AND FEES

4.1. In order to use the features of the Leave your luggage in Sofia Platform and the Services, you will be required to pay fees in the applicable currency – Euro. Before you pay any fees, you will have an opportunity to review and accept the fees that will be charged in the applicable currency. You will only be able to use the Services after you provide us with your payment details. We accept payment via one method – debit or credit card.

4.2. All payments by Customers to Leave your luggage in Sofia and by Leave your luggage in Sofia to Partners will be processed through Stripe, online payment system. Payments made through Stripe, will be subject to their automatic checks including fraud. By agreeing to use Leave your luggage in Sofia, you agree to the Terms of Agreement of Stripe available at www.stripe.com.

4.3. Under no circumstances, should you request or make any payment directly to Partners, outside the Leave your luggage in Sofia Platform.

4.4. You authorize Leave your luggage in Sofia to charge you fees for the Services you select, as described in these Terms and published by Leave your luggage in Sofia, including all applicable taxes and charges. As you pay any fees with a credit card, Leave your luggage in Sofia may seek pre-authorization of your credit card to verify that it is valid and has the necessary funds or credit available. These fees include but are not limited to:

4.4.1. Storage Fee. The fee that is due for the Luggage Storage Service (“Storage Fee”). The fees listed in this paragraph include the whole payment that is due to us for using our Services via Leave your luggage in Sofia Platform. You do not owe us any other additional fees apart from the fee set in 4.4.2 Terms of Agreement if you fail to pick up your Item(s) until the end of the 24-hour period of their storage at the Partner’s location.

For a big-size Item(s) the storage fee is € 6.49 per Item.

For a small-size Item(s) the storage fee is € 3.99 per Item.

4.4.1.1. Size of the Item(s): The booking via Leave your luggage in Sofia Platform can be done for Item(s) that meet the requirements as follows:

Big-size Item(s) is an Item that has the following measurements: 60х40х90 cm and/or does not weigh more than 30 kg.

Small-size Item(s) is an Item(s) that has the following measurements: 55х40х20 cm and/or does not weigh more than 10 kg.

4.4.1.2. Every Partner will post on the interactive map on the Leave your luggage in Sofia Platform information about the available number of Item(s) and their size that can be stored in their location. Leave your luggage in Sofia Platform cannot and will not be held liable for any inaccurate information posted by the Partner on the Platform. Sole accountability for such cases shall be held by the Partner.

4.4.1.3. You agree to not send any oversized packages to the Partners. You agree that Partners have the right to reject any package that Partners are uncomfortable accepting including oversized packages. For further clarification, every Partner has the right to refuse to store the Item(s) in their location if 1) said Item(s) do not meet the requirements mentioned in 4.4.1.1.; or if 2) the Customer has made a reservation for a specific Item(s) but present Item(s) with different size at the Partner’s location; or if 3) the Item(s) contains prohibited items described in detail in Section

3. PROHIBITED ITEMS of these Terms of Agreement. If the Customer presents an Item(s) with a different size than the one in the reservation and the Partner refuses to accept the Item(s) due to this same reason, the Customer will not be entitled to our Refund policy described in Section 6 STORAGE SERVICE and REFUND POLICY of these Terms of Agreement. If the Partner accepts the Customer’s Item(s) the Customer will not be obliged to pay any additional fees as all of the fees that are due are described in 4.4.1 of these Terms and are paid through the Leave your luggage in Sofia Platform.

4.4.1.4. Upon finishing your reservation you will have the option to clarify the specific time when you will be able to bring your Item(s) to the Partner’s location. Upon finishing your reservation through the Leaveyourluggageinsofia Platform you will receive an email with your confirmation number, the address and name of the Partner’s location.

You are solely responsible for bringing your Item(s) to the Partner’s location, where you will receive a sticker in which you will have to write your first and last name, phone number, time and date of the storing, which will then be attached to your Item(s) and will facilitate the trouble less pick-up of your Item(s).

4.4.2. Late Pick-Up Fee. If an Item is not picked up within the designated time limit of 24 hours, Customers will be charged a fee of € 20 fee per Item (“Late Pick-Up Fee”) for every 24-hour period during which you have not retrieved your Item(s). The Customer will be charged this Late Pick-Up Fee at the Partner’s location by the Partner and will be obliged to pay it at the same location when they come to collect their Item(s). Be informed that the Partner will not provide you with your Item(s) until you have paid the full amount of the Late Pick-Up Fee.

The Item(s) will remain at the Partner’s location until the Customer retrieves them unless their storage is accompanied by substantial expense or inconvenience for the Partner, in which case the Partner will have the right with a prior written via email notice to the Customer to transport the Item(s) to a storage facility and all the costs and fees charged by the storage facility shall be due by the Customer.

4.5. Leave your luggage in Sofia reserves the right to change the fees from time to time. We will use our best efforts to provide you with up-to-date information about fees. We encourage you to check our website https://leaveyourluggageinsofia.com to obtain up-to-date information about applicable fees. Fee changes will only affect bookings made after the effective date of the fee change.

5. RATE AND REVIEWS

After the Service is provided, Customers will have an opportunity to review the Partner and Partnering location as well as Leave your luggage in Sofia Platform. The review must be accurate and may not contain any discriminatory, offensive, defamatory, abusive, or aggressive language. For the purpose of Rate and Review of the Leave your luggage in Sofia Platform we will send you an email in a short period of time after the Service has been provided.

This Rate and Review is under no circumstance compulsory for you as our Customer, but would be highly appreciated. Furthermore, on the stickers attached to your Item(s) in the Partner’s location you will find a QR code which will direct you to our page on https://www.tripadvisor.com/, where you can leave a comment and rate our Service if you choose to do so.

6. STORAGE SERVICE AND REFUND POLICY.

6.1. For each Item stored, you must make a booking via the Leaveyourluggageinsofia Platform and follow the steps generated by the Platform.

6.2. Your booking for Luggage Storage Service includes the storage of your Item(s) for a period of twenty-four (24) hours. We do not provide Storage Service for other time periods. You are responsible for retrieving your Item(s) from Partner before the end of the Storage Period and provide reasonable proof in the face of you confirmation notice sent by the Leave your luggage in Sofia Platform to the email address which you have specified in the Platform that the Item(s) belong to you or that you have sufficient authority to retrieve the Item(s) and that your luggage is stored in the Partner’s Location.

6.3.  At the end of the Storage Period, if your Item has not been claimed, you understand and agree that you will be charged an additional fee of € 20 for every 24-hour period during which you have not retrieved your Item(s) as described in paragraph 4.4.2 of these Terms.

6.4.  Cancellations of your booking can be done during the first hour of the 24-hour period. Valid cancellation requests will be refunded and the money will be returned to the credit or debit card which you used to make the booking. You will receive the refund in a period of three business days from the date of the booking.

7. LICENSES

7.1. Subject to your complete and ongoing compliance with these Terms, Leave your luggage in Sofia grants you a limited, non-exclusive, non-transferable, non-sublicensable, non-commercial, revocable license for your personal use to access and use the Leave your luggage in Sofia Platform.

7.2. Except and solely to the extent such a restriction is impermissible under applicable law, you may not: (a) reproduce, distribute, publicly display, or publicly perform the Leave your luggage in Sofia Platform (b) make modifications to the Leave your luggage in Sofia Platform; or (c) interfere with or circumvent any feature of the Services and the Platform, including any security or access control mechanism. If you are prohibited under applicable law from using a Service or the Leave your luggage in Sofia Platform, you may not use it.

7.3. Under no circumstances are you permitted to access the Leave your luggage in Sofia Platform for the purpose of obtaining information about Partners, their employees, Partnering locations, Affiliates or any other information that is not for the direct purpose of engaging in a transaction with Leave your luggage in Sofia. If you, individually or on behalf of another company or service, engage in this behaviour, you agree to pay Leave your luggage in Sofia a fine of BGN 2000 multiplied by the number of instances data was improperly collected.

7.4. If you choose to provide input and suggestions regarding problems with or proposed modifications or improvements to the Services (“Feedback”), then you hereby grant Leave your luggage in Sofia an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to exploit the Feedback in any manner and for any purpose, including to improve the Leave your luggage in Sofia Platform, the Services and offer additional products and services.

8. LIMITATION OF LIABILITY

8.1. To the fullest extent permitted by law, in no event will the Leave your luggage in Sofia Platform, the Partners or their Affiliates be liable to you for any indirect, incidental, special, consequential or punitive damages (including damages for loss of profits, goodwill, or any other intangible loss) arising out of or relating to your access to or use of, or your inability to access or use, the Leave your luggage in Sofia Platform, the Services or any materials or content made available by Leave your luggage in Sofia, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not any Leave your luggage in Sofia entity, Partner, or any of their

Affiliates have been informed of the possibility of damage the aggregate liability of the Leave your luggage in Sofia to you for all claims arising out of or relating to the use of or any inability to use any portion of the services, or otherwise under these Terms, whether in contract, tort, or otherwise, is limited to the amount you have paid for the Service and/or Other Service via the Leave your luggage in Sofia Platform.

8.2. Each provision of these Terms of agreement that provides for a limitation of liability, disclaimer of warranties, or exclusion of damages is intended to and does allocate the risks between the Parties under these Terms. This allocation is an essential element of the basis of the bargain between the Parties. Each of these provisions is severable and independent of all other provisions of these Terms of agreement.

The limitations in this section will apply even if any limited remedy fails for its essential purpose. Any claim for loss, mishandling, theft, or conversion of, or damage to, an Item shall be filed directly with the Partners. You acknowledge and agree that your primary remedy for any loss, mishandling, theft, conversion of, or damage to the Item(s) stored, is to file a claim with the Partner as set forth in these Terms and not with Leave your luggage in Sofia Platform.

9. INDEMNIFICATION

9.1. To the maximum extent permitted by applicable law, you agree to release, defend (at Leave your luggage in Sofia’s option), indemnify, and hold Leave your luggage in Sofia (including Leave your luggage in Sofia’s affiliates, and their personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with

(1) your breach of these Terms of agreement (including any additional terms, Policies or Standard that may apply); (2) your improper use of the Leave your luggage in Sofia Platform or the Services or Other Services, (3) your interaction with any Partner including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction or use,

(4) your breach of any laws, regulations or third party rights such as intellectual property or privacy rights. The indemnification obligation only applies if and to the extent that the claims, liabilities, damages, losses, and expenses have been adequately caused by your culpable breach of a contractual obligation.

9.2. To the fullest extent permitted by law, you are responsible for your use of the Leave your luggage in Sofia Platform and Services and Other Services, and you will defend and indemnify Leave your luggage in Sofia and its officers, directors, employees, consultants, affiliates, subsidiaries and agents (together, the “Leave your luggage in Sofia Entities”) and the Partners and each of their officers, directors, employees, consultants, affiliates, subsidiaries and agents (together with the Leave your luggage in Sofia Entities, the “Indemnitees”) from and against every claim brought by a third party, and any related liability, damage, loss, and expense, including reasonable attorneys’ fees and costs, arising out of or connected with:

(a) your use of, or misuse of, the Leave your luggage in Sofia Platform or the Services or the Other Services; (b) your violation of any portion of these Terms of agreement, any representation, warranty, or agreement referenced in these Terms of agreement, or any applicable law or regulation; (c) your violation of any third party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; or (d) any dispute or issue between you and any third party.

The applicable Indemnitee(s) reserve the right, at their own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in that case, you agree to cooperate with their defence of those claims.

10. TERM, TERMINATION, AND SUSPENSION

10.1. These Terms of Agreement are effective when you use the Leave your luggage in Sofia Platform and end when terminated as described in these Terms. The agreement between you and Leave your luggage in Sofia reflected by these Terms of agreement remains in effect until either you or we terminate the agreement in accordance with these Terms of agreement.  

  • We may terminate this agreement immediately and without prior notice and stop providing access to the Leave your luggage in Sofia Platform if (i) you materially breach these Terms of agreement; (ii) you violate applicable laws, or (iii) such action is necessary to protect the safety or property of Leave your luggage in Sofia, Partners or their staff, or third parties (for example in the case of fraudulent behaviour). 

10.2. Upon termination of these Terms of Agreement: (a) your license rights will terminate and you must immediately cease all use of the Leave your luggage in Sofia Platform and the Services and the Other Services; (b) you will no longer be authorized to access the Leave your luggage in Sofia Platform, or the Services;

(c) you must pay Leave your luggage in Sofia any unpaid amount that was due prior to termination; (d) all payment obligations accrued prior to termination and all other provisions of these Terms that, by their nature or express terms, should survive termination.

11. INTELLECTUAL PROPERTY RIGHTS

The Leave your luggage in Sofia Platform is owned and operated by Leave your luggage in Sofia. The visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, and other elements of the Leave your luggage in Sofia Platform and the Services (“Materials”) provided by Leave your luggage in Sofia are protected by intellectual property and other laws.

All Materials are the property of Leave your luggage in Sofia or its third-party licensors. Except as expressly authorized by Leave your luggage in Sofia, you may not make use of the Materials. Leave your luggage in Sofia reserves all rights to the Materials not granted expressly in these Terms of Agreement. You hereby release Partners and their Affiliates from any and all claims related to the Leave your luggage in Sofia Platform, the Services, or the Materials.

12. MISCELLANEOUS

12.1. Prohibited Conduct. By using Leave your luggage in Sofia Platform and the Services and the Other Services you represent and warrant to Leave your luggage in Sofia, Partners, and their Affiliates that you will not (a) use the Leave your luggage in Sofia Platform and the Services for any illegal purpose or in violation of any applicable laws;

(b) violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third party intellectual property right; (c) interfere with security-related features of the Leave your luggage in Sofia Platform including by (i) disabling or circumventing features that prevent or limit use or copying of any content, or (ii) reverse engineering or otherwise attempting to discover the source code of any portion of the Leave your luggage in Sofia Platform except to the extent that the activity is expressly permitted by applicable law;

(d) perform any fraudulent activity including impersonating any person or entity, claiming a false affiliation, accessing the Bounce Platform or the Services without permission; (e) sell or otherwise transfer the access granted under these Terms of Agreement or any Materials or any right or ability to view, access, or use any Materials; (f) collect content or information from any portion of the Leave your luggage in Sofia Platform using automated means (including through the use of any robot, spider, site search/retrieval application, or other device or method to retrieve, index, “scrape,” or “data mine”);

(g) use any content or information about businesses or users that is available on any portion of the Leave your luggage in Sofia Platform to solicit business from those businesses or users; or attempt to do any of the acts described in this Section or assist or permit any person in engaging in any of the acts described in this Section and (h) behave in a violent or aggressive manner toward Leave your luggage in Sofia and its employees, Partners and their employees or their Affiliates. 

12.2. Modifications of these Terms of Agreement. Leave your luggage in Sofia reserves the right to change these Terms of Agreement from time to time. We will provide you with the up-to-date version of these Terms of Agreement by publishing it on our website. Disputes arising under these Terms will be resolved in accordance with the version of these Terms that was in effect at the time the dispute arose.

12.3. Modifications of the Leave your luggage in Sofia Platform or the Services or the Other Services. Leave your luggage in Sofia reserves the right to modify or discontinue the Leave your luggage in Sofia Platform or the Services or the Other Services at any time (including by limiting or discontinuing certain Services or features of the Services or the Leave your luggage in Sofia Platform or the Other Services), temporarily or permanently, without notice or publication on our website. Leave your luggage in Sofia, Partners, and their Affiliates will have no liability for any change to the Leave your luggage in Sofia Platform or the Services or the Other Services or any suspension or termination of your use of the Services or the Leave your luggage in Sofia Platform.

12.4. Disclaimers; No Warranties. The Leave your luggage in Sofia Platform, the Services, the Other Services and all Materials and content made available by Leave your luggage in Sofia are provided “as is” and on an “as available” basis.

Leave your luggage in Sofia, the Partners, and their Affiliates disclaim all warranties of any kind, whether express or implied, relating to the Leave your luggage in Sofia Platform, the Services, the Other Services and all materials and content available through the Leave your luggage in Sofia Platform, and the Services, including (a) any implied warranty of merchantability, fitness for a particular purpose, title, quiet enjoyment, or non-infringement; and (b) any warranty arising out of the course of dealing, usage, or trade. Leave your luggage in Sofia, Partners, and their Affiliates do not warrant that the Leave your luggage in Sofia Platform, the Services, the Other Services or any materials or content made available by Leave your luggage in Sofia, will be uninterrupted, secure, or free of errors, viruses, or other harmful components, and Leave your luggage in Sofia, Partners, and their Affiliates do not warrant that any of those issues will be corrected.

No advice or information, whether oral or written, obtained by you from the Leave your luggage in Sofia Platform, the Services, other Services or Leave your luggage in Sofia entities, Partners or their Affiliates, or any Materials or content made available by Leave your luggage in Sofia will create any warranty regarding any of the Leave your luggage in Sofia entities, Partners, their Affiliates, the Leave your luggage in Sofia Platform or the Services or the Other Services that are not expressly stated in these Terms.

We are not responsible for any damage that may result from your dealing with any other service user. You understand and agree that you use the Leave your luggage in Sofia Platform and the Services at your own discretion and risk, and that Leave your luggage in Sofia and their Affiliates are not responsible for any damage to your property (including your computer system or mobile device used in connection with the Leave your luggage in Sofia Platform and the Services) and are not obliged to retrieve your Content.

The limitations, exclusions, and disclaimers in this section apply to the fullest extent permitted by law. Leave your luggage in Sofia does not disclaim any warranty or other right that Leave your luggage in Sofia is prohibited from disclaiming under applicable law.

12.5. Third-Party Services and Linked Websites. Leave your luggage in Sofia may provide tools through the Leave your luggage in Sofia Platform that enable you to export information, to third-party services. By using one of these tools, you agree that Leave your luggage in Sofia may transfer that information to the applicable third-party service. Third-party services are not under Leave your luggage in Sofia’s control, and, to the fullest extent permitted by law, Leave your luggage in Sofia is not responsible for any third-party service’s use of your exported information.

The Leave your luggage in Sofia Platform may also contain links to third-party websites. Linked websites are not under Leave your luggage in Sofia’s, the Partner’, or their Affiliates’ control, and Leave your luggage in Sofia, the Partners, and their Affiliates are not responsible for their content.

12.6. Third-Party Software. The Leave your luggage in Sofia Platform may include or incorporate third-party software components that are generally available free of charge under licenses granting recipients broad rights to copy, modify, and distribute those components (“Third Party Components”). Although the Leave your luggage in Sofia Platform is provided to you subject to these Terms of Agreement, nothing in these Terms of Agreement prevents, restricts, or is intended to prevent or restrict you from obtaining Third Party Components under the applicable third party licenses or to limit your use of Third Party Components under those third party licenses.

12.7. GDPR Policy. We collect, use, and disclose information from or about you as described in our GDPR Policy. Additional privacy policies may apply, including from Partners and third-service providers. 

12.8. Additional Terms. Your use of the Leave your luggage in Sofia Platform and the Services and the Other Services are subject to all additional terms, policies, rules, or guidelines applicable to the Leave your luggage in Sofia Platform and Services that we may post on or link to from the Leave your luggage in Sofia Platform. 

12.9. Other Terms Incorporated by Reference. These Terms of Agreement, together with the GDPR Policy and any other agreements expressly incorporated by reference into these Terms of agreement, are the entire and exclusive understanding and agreement between you and Leave your luggage in Sofia regarding your use of the Leave your luggage in Sofia Platform and the Services and the Other Services.

All Additional Terms are incorporated by this reference into and made a part of, these Terms.

12.10. Interpreting these Terms. If any part of these Terms of Agreement is held to be invalid or unenforceable, the unenforceable part will be given effect to the greatest extent possible, and the remaining parts will remain in full force and effect.

13. GOVERNING LAW AND JURISDICTION

These Terms of Agreement are governed by and construed in accordance with Bulgarian law. If you are acting as a consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of Bulgarian law. As a consumer, you may bring any judicial proceedings relating to these Terms of Agreement before the competent court of your place of residence. If Leave your luggage in Sofia wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident.

By accepting these Terms of Agreement, you agree to be bound by these Terms of Agreement.
